Agreement to Terms

By accessing and using TopFound's website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this site.

Use License

Permission is granted to temporarily download one copy of the materials on TopFound's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Service Description

TopFound provides software development services including but not limited to:

  • Python backend development
  • Flutter mobile application development
  • React web application development
  • Cloud architecture and advisory services

Project Terms

Scope of Work

Each project will be defined by a separate Statement of Work (SOW) that outlines the specific deliverables, timeline, and payment terms.

Timeline and Deliverables

Project timelines are estimates based on the information provided during the discovery phase. Actual delivery dates may vary based on project complexity and client feedback cycles.

Payment Terms

Payment terms will be specified in each project's SOW. Generally, we require:

  • 50% payment to begin work
  • 50% payment upon project completion
  • Payment due within 30 days of invoice date

Intellectual Property

Upon full payment, all custom code, designs, and deliverables created specifically for your project will be owned by you. We retain the right to use general knowledge, skills, and methodologies developed during the project.

Confidentiality

We understand the importance of protecting your confidential information. We will:

  • Keep all project information confidential
  • Not disclose your information to third parties without consent
  • Use your information only for the purpose of providing our services
  • Return or destroy confidential information upon project completion

Limitation of Liability

In no event shall TopFound or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on TopFound's website, even if TopFound or an authorized representative has been notified orally or in writing of the possibility of such damage.

Warranty Disclaimer

The materials on TopFound's website are provided on an 'as is' basis. TopFound makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Revisions and Errata

Termination

Either party may terminate a project with 30 days written notice. Upon termination, you will be billed for work completed to date, and we will provide all deliverables completed up to the termination date.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of California, United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.

Changes to Terms

TopFound may revise these terms of service at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.
